Sounds like the pound is trying to pin this on the employee, but I doubt this was a lapse in judgment rather than policy. No tags? No microchip? Stray. Probably happens all the time, just not to hero dogs. Also, if your dog has no tags or any other identifying marks, it's probably best to give the pound a jingle rather than just assume they're closed for the weekend.
